Do I forfeit pay if I signed an employment contract but quit my job without notice?

I live in Virginia.

My employment contract is not for a designated period of time but part of it states that I have to give three weeks’ notice. There is nothing about the consequences of not giving notice. I am a salaried, management employee. If I leave without notice, can they withhold my last paycheck? Or take me to court if they’re left in a bind? What can happen?

    I believe that you MUST be paid for working – period. An employer cannot withhold pay for time you worked – even if they’re angry with you! I also believe that you must receive that pay on the next regular pay day, just as if you hadn’t left. All you have to do is look up the Labor and Industry site and take a look at the law. I feared an employer would do that to me – I had given notice, but they then told me to leave without staying the two-weeks of the notice (I guess it was like, you can’t quit, you’re fired – childish and stupid on their part). Anyway, I looked up the law and learned that you must be paid for time you work and there is no provision for being punished so you’re good with that. They can’t take you to court for leaving and they probably won’t do any retaliating at all — the only thing that can happen is you won’t be able to use them as a reference going forward because they won’t give you a good recommendation. As long as you can live with that – move on and don’t worry about it. I’m assuming you either already got another job or your life circumstances changed suddenly? If you left without giving notice because something happened at work there though — if you were threatened or had a problem with someone at work and left to kind of save yourself from being abused in some way or whatever — then you have a cause of action against them…Again, look at the Labor and Industry site – that will help you a lot.

    Even though there is nothing in your contract about the consequences they can use that as a loop hole so you would be best to check it out with human resources and you are better off giving three weeks notice, You could even through those three weeks notice be off sick – I guess it is a bit disernest but you could do that and also use hoilidays if you are starting another job whist in those three weeks – Just an excuse so you can do your three weeks notice
